General Terms and Conditions (GTC) for the
Utilisation of services by Christian Sutter
1. general information
I, Christian Sutter, provide my services exclusively on the basis of the following conditions
General Terms and Conditions (GTC). These apply to all legal relationships between me and those persons who use the services (hereinafter referred to as "customer"), even if no express reference is made to them.
The services include the provision of instruction in the skills and knowledge of skiing (with no guarantee of specific training success) and the accompaniment of skiing.
The version valid at the time the contract is concluded shall apply. Deviations from these and other supplementary agreements with the customer are only effective if they have been confirmed in writing.
Any terms and conditions of the customer are not accepted, even if known, unless otherwise expressly agreed in writing in individual cases. I, Christian Sutter, expressly object to the customer's general terms and conditions.
Insofar as this contract refers to natural persons only in the masculine form, they refer to women and men in the same way.

3. terms of payment
A contract between Christian Sutter and the customer is only concluded once the written booking confirmation has been sent and a deposit of at least 50% of the invoice amount has been paid by bank transfer or the full amount.
The invoice amount is due upon receipt of the invoice. In the event of late payment by the invoice recipient, we are entitled to charge interest on arrears in the amount of 5% per annum.

5. cancellation by the customer
The customer is entitled to withdraw from the concluded contract at any time against payment of the cancellation costs listed below.
To exercise the right of withdrawal (cancellation), the customer must send a declaration of withdrawal by e-mail.
6. cancellations:
Cancellations up to one month before the first day of skiing are free of charge. Cancellations from one month before the first day of skiing will be charged at 80% of the agreed rate. Bad weather conditions are not a reason for cancellation. In the event of cancellation due to accident or illness during the ski holiday, a certificate from a local doctor must be presented so that the corresponding days are not charged.
7. resignation
If the weather conditions do not guarantee the performance of the booked service for safety reasons, Christian Sutter has the option of postponing or cancelling the booked service. In the event of cancellation of the booked service, Christian Sutter undertakes to refund the fee paid for the booked service to the customer.
8. accident insurance
The customer acknowledges that the practice of skiing is associated with numerous risks. The customer further acknowledges that rescue, in particular by air rescue, can lead to high costs. The customer is advised to take out appropriate leisure insurance (in particular to cover rescue and air rescue costs).
9. liability
In particular, Christian Sutter accepts no liability whatsoever for damage caused by the customer to himself or other persons during the performance of the agreed service or caused to him by such persons.
10 Applicable law
Austrian law shall apply.
